PAGAProtector (the "App" or "Service") is a tool designed to help restaurants and other California businesses facilitate employee attestations regarding compliance with labor laws, including meal and rest breaks, tips, wages, and related matters. However, the App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind.

No Guarantee of Protection or Compliance

Use of the App does not guarantee that you will avoid lawsuits, PAGA claims, Labor Board complaints, or any other legal actions.
The App does not constitute legal advice, nor does it ensure full compliance with the California Labor Code, PAGA (Private Attorneys General Act), or any other federal, state, or local laws.
Attestations collected through the App may be helpful evidence, but they do not create an absolute defense against claims. Courts, agencies, or juries may weigh or reject such evidence for any reason.
We make no representations or warranties regarding the effectiveness of the App in preventing, defending, or reducing liability for any labor disputes, penalties, fines, or damages.

No Liability

To the fullest extent permitted by California law, Wicked Good Restaurants, LLC / PAGAProtector, its owners, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:

Any labor law violation claims, PAGA actions, or lawsuits filed against you.
Loss of data, business interruption, legal fees, settlements, judgments, or other financial losses.
Any alleged failure of the App to capture, store, or present attestations correctly.

    You assume all risks associated with using the Service. Your reliance on the App is entirely at your own risk.
